Terms and Conditions of Sale

These Terms and Conditions of Sale (T&Cs) govern the sales made on the Graindesell.shop (hereinafter "Grain de Sell ") by Grain De Sell  to customers. By placing an order on the Site, the Customer fully accepts these terms and conditions.

1. Products

The products offered for sale on the Site are second-hand clothing, carefully selected, authenticated, inspected, and listed with a detailed description of their condition (new, good condition, worn, etc.), along with photographs. The photos are for illustrative purposes and may slightly differ from the items received.

2. Orders

The Customer may place an order directly on the Site. Once the order is placed, the Customer will receive a confirmation email including a summary of the order. The order will only be validated after payment has been received. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a prior dispute or in the event of non-payment.

3. Prices

The prices of products are displayed in euros, including all taxes (VAT), excluding delivery charges. Delivery charges will be added to the order before final validation, and they will be clearly indicated. The Seller reserves the right to change the prices at any time, but products will be charged at the prices in effect at the time of order confirmation.

4. Payment

Payment is made online by credit card or any other payment method available on the Site. The transaction is secured by an approved payment provider. Payment must be made in full at the time of ordering.

5. Delivery

Orders are delivered to the address provided by the Customer at the time of the order. Delivery times are indicated on the Site and are provided as estimates. The Seller will make efforts to meet these times, but cannot be held responsible for delays due to external events or by delivery services.

6. Customs fees

Please note that we are not responsible for any customs fees or taxes that may apply to your order, depending on the laws in your country. These fees are the responsibility of the customer and must be paid directly to the relevant customs authorities.

Additionally, no refunds will be issued in case of a refused shipment, for any reason. It is the customer's responsibility to ensure acceptance of the order before completing the purchase.

7. Right of Withdrawal

In accordance with Article L. 221-18 of the French Consumer Code, the Customer from UE has the right to withdraw from the contract within 14 days from the receipt of the products. To exercise this right, the Customer must notify the Seller of their decision in writing (email or letter) and return the products in their original condition (unworn, with tags intact, etc.). Return shipping costs are at the Customer’s expense. Products that are incomplete, damaged, or soiled will not be refunded. Check Return Policy for more informations.

8. Warranty and Returns

The products sold on the Site are second-hand items. The Seller strives to provide items in good condition and describes each product accurately. However, due to their nature, second-hand clothing does not benefit from the legal warranty of conformity (except in the case of hidden defects). If a product presents an undisclosed defect in its description, the Customer may contact the Seller to discuss an exchange or refund, subject to the Seller’s agreement.

9. Liability

The Seller cannot be held responsible for direct or indirect damages resulting from the use of the products sold. The Seller cannot be held responsible for any incident related to the storage or use of the products by the Customer after receipt.

10. Personal Data Protection

In accordance with the General Data Protection Regulation (GDPR) (EU Regulation 2016/679 of April 27, 2016), personal data collected during the order process will only be used to process the order. The Customer has the right to access, rectify, and erase their personal data by contacting the Seller at the following address: Contact.graindesell@gmail.com.

11. Intellectual Property

All elements of the Site (texts, images, logos, etc.) are protected by copyright and remain the exclusive property of the Seller. Any unauthorized reproduction or use of these elements is prohibited.

12. Modifications of the Terms and Conditions of Sale

The Seller reserves the right to modify these Terms and Conditions of Sale at any time. Modifications will be effective as soon as they are published on the Site.

13. Governing Law and Jurisdiction

These T&Cs are governed by French law. In the event of a dispute, French courts will have jurisdiction.
